Terms of Service

Version 1.0.0 · In force since 17 October 2026

This is an English translation provided for convenience. Only the Polish version of the Terms of Service is legally binding.

Summary

  • wybiegaj.com is operated by Voltex Software Łukasz Walter. Contact: kontakt.wybiegaj@gmail.com.
  • You can create an account if you are at least 16 years old. The account and the basic features of the Service are free.
  • Events are virtual: you do the activities on your own, wherever and whenever you choose, within your counting window. You are responsible for your own health and safety during the activities.
  • We ship the starter pack (e.g. a medal) only after you complete the event within your counting window. If you do not complete the event, we do not ship the pack and the fee is non-refundable.
  • Your registration is final – as participation in a sports event with set dates, it carries no right of withdrawal (Art. 38(1)(12) of the Polish Consumer Rights Act). This does not limit your rights in the event of a complaint or if we cancel an event.
  • We deliver packs within Poland only: to an InPost Paczkomat parcel locker at no extra cost, or by InPost courier for a surcharge shown before payment.
  • We reply to complaints within 14 days.
  • Cheating (e.g. someone else's, inflated or fabricated activities) may result in your result and completion being voided – and thus in losing the pack without a refund – and in your account being blocked.
  • This is only a summary – the full text of the Terms below is binding.

§ 1. General provisions

1. These terms of service (the “Terms”) set out the rules for using the wybiegaj.com service, including the rules for creating and maintaining an Account, taking part in Events, ordering and delivering Packs, payments, promotions, the Patron Programme and complaints.

2. The Service is operated by Voltex Software Łukasz Walter, Wilków 42B, 58-125 Wilków (Świdnica commune), Poland, an entrepreneur entered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP) 8842572758, REGON 388685218 (the “Operator”, “we” or “us”).

3. You can contact the Operator by email at kontakt.wybiegaj@gmail.com or in writing at the Operator's registered address.

4. These Terms are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronically supplied services. We make them available free of charge in the Service – before a contract is concluded and at any time afterwards – in a form that allows them to be downloaded, stored and printed.

5. Before creating an Account, the User reads and accepts these Terms and the Privacy Policy. The Privacy Policy describes how we process personal data.

6. These Terms apply to all contracts concluded through the Service, in particular the Account agreement and Registrations. The detailed conditions of a given Event are set out on its Event Page, which forms part of the Registration; in the event of any discrepancy, the Event Page prevails as the more specific provision.

Dates and times in these Terms and in the Service refer to the official time in Poland.

§ 3. Technical requirements and security

1. To use the Service you need:

  1. a device with Internet access;
  2. for the website and the web application – an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript and browser local storage enabled; for the mobile application – a device running a version of Android or iOS supported by the current version of the App;
  3. an active email address;
  4. to import Activities – a Strava account, and to sign in with Google, Apple or Facebook – an account with that provider.

2. Using electronically supplied services involves typical risks such as malware, phishing for login details and unauthorised access to an Account. We recommend using a strong and unique password, not sharing it with anyone, signing out on shared devices and keeping your software up to date. We never ask for your password by email or phone.

3. Users must not provide unlawful content.

§ 4. Services provided in the Service

1. In the Service we provide in particular the following services:

  1. maintaining an Account – free of charge;
  2. browsing Events and Rankings – free of charge;
  3. recording Activities, including importing them from Strava and recording them in the App, and tracking progress – free of charge;
  4. emails and notifications related to using the Service – free of charge;
  5. the newsletter and marketing notifications – free of charge, only with the User's consent;
  6. participation in Events – under a Registration, for a fee or free of charge, as set out on the Event Page;
  7. the Patron Programme – in accordance with § 16.

2. The Account agreement is concluded for an indefinite period when the Account is activated. The User may terminate it at any time, without giving reasons and at no cost, by deleting the Account in the App (Settings → Delete account) or by emailing us from the address assigned to the Account.

3. The agreement for using features of the Service available without an Account (e.g. browsing the website) is concluded when you start using them and ends when you stop.

4. We may develop and change the free features of the Service and, for important reasons (e.g. technological changes, security, changes in the law, a change of service providers or a feature not being economically viable), also discontinue them. This does not affect Registrations already concluded: Events for which a Participant is registered are carried out on the existing terms.

§ 5. Account

1. An Account is created by providing an email address and a password or by signing in with Google, Apple or Facebook. An Account created with an email address is activated with a code sent to that address. An Account that is not activated within 30 days of registration is deleted.

2. An Account may be created by a person who is at least 16 years old. A person under 18 may conclude paid contracts – in particular Registrations for paid Events – only with the consent of their legal guardian (parent or guardian); by concluding such a contract, they declare that they have obtained that consent. By accepting these Terms, the User confirms that they are at least 16 years old.

3. Each person may have only one Account. The Account is personal: it must not be shared, sold or transferred to other people, and Accounts must not be created on behalf of other people.

4. The User provides true information and updates it when it changes. The User is responsible for keeping their password secret and must inform us without delay if they suspect unauthorised access to their Account.

5. The User's display name is visible to others in Rankings. When signing in with Google, Apple or Facebook, the first name or name provided by that provider becomes the default display name. The User may change the display name or hide from Rankings at any time (Settings → Personal details → “Hide me in rankings”) – we then show “Participant” instead of their name.

6. The display name must not infringe the law, personal rights or the rights of others, must not be misleading (e.g. by impersonating another person or the Operator) and must not contain offensive or advertising content. We may change or hide a display name that breaks these rules.

7. Signing in with Google, Apple or Facebook is subject to the rules set by those providers. We are not responsible for their services being unavailable.

8. Deleting an Account is irreversible. When the Account is deleted:

  1. the User loses access to the Account, Activities and the history of their participation in Events; we delete the Activities and the User's results disappear from Rankings;
  2. unused Vouchers expire;
  3. if the Participant has not completed an Event for which they are registered, they are deemed to have withdrawn from it – we do not ship the Pack and the Fee is non-refundable; we ship the Pack for an Event completed before the Account was deleted to the address provided;
  4. we keep order and billing data for the period required by law, as described in the Privacy Policy.

§ 6. Events

1. Events are virtual. The Participant performs Activities on their own – in a place, at a time and at a pace of their choosing, within their Counting Window – and records them in the Service. The Operator does not set routes, does not organise the physical course of the activities, does not provide any services, safety measures or medical care during them and does not supervise them. An Event is not a mass event.

2. On the Event Page we set out in particular: the registration period, the Event dates or the length of the individual Counting Window, the Requirements, the accepted Activity types, the available Packs and their prices, the participant limit (if any), the Ranking rules and whether the Event ends for a Participant upon Completion.

3. An Event may have:

  1. fixed dates – common start and end dates for all Participants. The Counting Window runs from the start to the end of the Event. If a Registration is confirmed after the Event has started, the Counting Window starts at the beginning of the day on which the Registration was confirmed, unless the Event Page states that Activities performed since the start of the Event also count;
  2. an individual window – each Participant has the number of days set out on the Event Page to complete the Event. The Counting Window starts at the beginning of the day on which the Registration was confirmed (this is the first day of the window) and ends at 23:59:59 on the last day of the window.

4. We determine the Counting Window when the Registration is confirmed, and the Participant can see its dates in the App. We may extend an Event or Counting Windows – such changes only ever benefit Participants. Once registration has opened, we do not change the Requirements, Packs or prices to the detriment of Participants.

5. We accept Registrations during the period stated on the Event Page, until the participant limit or the available Packs or their variants (e.g. sizes) run out. You may register for a fixed-date Event after it has started if registration is still open – subject to section 3(1).

6. If the Event Page so provides, the Event ends for a Participant upon Completion – later Activities no longer change their progress or Ranking result.

7. We may cancel an Event only for an important reason, in particular force majeure, decisions of public authorities, changes in the law or a permanent inability to deliver the Packs for reasons beyond our control. We inform Participants of the cancellation without delay and refund in full the Fees for Registrations for which we have not yet shipped the Pack within 14 days of the cancellation – using the same means of payment as the Participant used, unless the Participant agrees to another refund method that involves no costs for them.

§ 7. Registering for an Event

1. A Registration requires an Account. In the Registration form the User chooses a Pack and its variants (e.g. size), the delivery method and delivery details, and may enter a Discount Code, a Patron code and invoice details. Then – after reviewing the summary showing the total amount payable – the User confirms the order with the “Pay” button (paid Events) or the “Register” button (free Events). Pressing “Pay” means placing an order with an obligation to pay.

2. We accept payments through the PayU payment service operated by PayU S.A., based in Poznań. The available payment methods (e.g. BLIK, payment cards, fast bank transfers) are shown on the PayU payment page. We have no access to payment card details or online banking login details.

3. Payment should be made without delay – the payment link is valid for 30 minutes. We cancel unpaid orders automatically; until payment has started, the User may also cancel the order themselves. A cancelled order is not binding on either party.

4. The Registration is concluded when it is confirmed by the Service, which happens after the payment has been credited or, for a free Registration, immediately after the order is placed. We send the Registration confirmation, together with the text of these Terms, to the email address assigned to the Account.

5. If, after the payment has been credited, the Registration cannot be confirmed – in particular because the participant limit or Packs have run out or registration has closed – the Registration does not take effect and we refund the amount paid in full within 14 days, using the same means of payment as the User used.

6. You may register for an Event only once from one Account. A Registration is personal and cannot be transferred to another person.

7. The Participant may change the Pack variants (e.g. size) in the App until Completion, subject to availability. The delivery method cannot be changed once payment has started; the delivery address can be changed until Completion.

8. We issue invoices on request. Businesses provide invoice details (including the tax ID) in the Registration form. A Consumer may request an invoice by writing to kontakt.wybiegaj@gmail.com within 3 months of the end of the month in which they paid. We send invoices electronically, which the User accepts, and where required by law we also make them available in the Polish National e-Invoicing System (KSeF).

§ 8. Prices and Fees

1. Prices in the Service are given in Polish zloty. They are final prices, including taxes where applicable. Before placing an order, the User sees the total amount payable, broken down into the price, discounts and the courier delivery surcharge.

2. Delivery to an InPost Paczkomat parcel locker is included in the price. Delivery by InPost courier requires a surcharge in the amount shown when choosing the delivery method; the surcharge also applies to free Packs.

3. The Fee is remuneration for participating in the Event – including the opportunity to attempt Completion, the use of the Event features (progress tracking, Ranking) and the preparation and shipping of the Pack after Completion. The Fee is neither the price of the Pack alone nor a donation.

§ 9. Activities and Completion

1. Only Activities that meet all of the following conditions count towards an Event:

  1. they were performed personally by the Participant, truthfully and in the spirit of fair play;
  2. they are of a type accepted on the Event Page;
  3. they started within the Participant's Counting Window;
  4. they have not been deleted and are not duplicates of an Activity already counted.

2. Activities can be imported from Strava, after connecting the Account to it, entered manually or recorded in the App. Recording covers runs, walks, rides and hikes: the App – with the Participant's permission to access the device's location – calculates the distance and time from the GPS record between starting and ending the recording, and only the Participant can see the route of a recorded Activity. The Strava import covers runs, walks, rides, swims and hikes; other types of activity are recorded as “other”. Steps can only be entered manually. Activities marked as private on Strava count towards the Participant's progress but are not included in Rankings. The Service is not sponsored, endorsed or administered by Strava, Inc.

3. A manual entry may not concern a future Activity or one that started more than 30 days before it is entered. We apply plausibility limits (e.g. a maximum speed for each type of activity, a maximum distance and duration of a single Activity) – an entry exceeding a limit will not be accepted. The same rules apply to an Activity recorded in the App; in addition, its distance must match the recorded route. Activities can be deleted, and manually entered ones also edited, within 30 days of their start; in an Activity recorded in the App the name and photo can be changed.

4. The Service determines progress and Completion automatically on the basis of the recorded Activities. The Participant should record Activities as they go: we take into account Activities started within the Counting Window if they are imported or entered no later than 30 days after the end of the Event. We are not responsible for an Event not being completed because Activities were recorded late, because of measurement errors of the Participant's device or because Strava was unavailable – in such cases the Participant may enter the Activity manually within the limits of section 3.

5. Completion is final – later deleting or changing an Activity does not reverse it – subject to section 6.

6. We may verify Activities and results, including asking the Participant for additional proof (e.g. a link to the activity on Strava, a screenshot or a workout file). If an Activity was performed or recorded in breach of these Terms (e.g. by another person, using a vehicle, or with manipulated GPS records or data), or if the Participant fails to confirm its plausibility within the time limit we set, which will not be shorter than 7 days, we may disregard the Activity, remove the result from the Ranking and void the Completion, and in the event of a serious or repeated breach – apply the measures described in § 19. If a Completion is voided, we do not ship the Pack and the Fee is non-refundable. We inform the Participant of the measures taken and the reasons for them; the Participant may appeal in accordance with § 18(6).

§ 10. Health and safety

1. Participation in an Event is voluntary. The Participant decides independently on the place, time, conditions, intensity and manner of performing Activities and assesses for themselves whether their health allows physical exertion. Before starting training – especially after a long break, with chronic conditions, injuries, during pregnancy or when taking medication – we recommend consulting a doctor.

2. The Participant performs Activities in a manner that is safe for themselves and others, in accordance with the law (in particular road traffic regulations) and the rules applicable in the places where they train, and with due care – in particular by adjusting their effort to their abilities and the weather, using appropriate equipment (e.g. a helmet when cycling), not using their phone in a way that endangers safety and not entering areas where access is prohibited.

3. The Operator does not provide Participants with insurance, including accident insurance or third-party liability insurance. We recommend taking out such insurance yourself.

4. The data presented in the Service (e.g. distance, pace, time, calories) are for information only. The Service is not a medical device and is not intended for diagnosing or monitoring health.

5. Since the Operator has no influence on how, where and in what conditions Activities are performed, it is not liable for damage arising in connection with performing them, unless the damage results from circumstances for which the Operator is responsible. This provision does not exclude or limit the Operator's liability for personal injury or any other liability that cannot be excluded or limited under mandatory law.

6. The legal guardians of a Participant under 18 assess whether participating in an Event is safe for them and supervise them.

§ 11. Rankings

1. If the Event Page so provides, we maintain a Ranking of the Event (e.g. by pace, total distance or average pace). Depending on the Event settings, the Ranking may be visible to the Event's Participants, to all signed-in Users or publicly on the Service's website.

2. In the Ranking we show the position, the Participant's display name (or “Participant” if they have hidden from Rankings), the result, the distance and whether the Event was completed; we may also show the number of Participants.

3. The Ranking does not include Activities marked as private on Strava, duplicates or implausible results – in particular Activities with a pace faster than the thresholds we apply for the given type of activity.

4. Rankings are for information and recreation only and are not an official sports classification. We do not award prizes for Ranking positions unless the Event Page provides otherwise – in which case the Event Page sets out the rules for awarding them.

§ 12. Packs and delivery

1. We ship the Pack only to a Participant who has completed the Event within their Counting Window. We order shipping after Completion – also while the Event is still running for other Participants – and dispatch the Pack within the time stated on the Event Page or, if none is stated, without undue delay and no later than 30 days after the day of Completion.

2. If the Participant does not complete the Event within their Counting Window for reasons for which the Operator is not responsible – including illness, injury, lack of time or giving up – we do not ship the Pack and the Fee is non-refundable, in whole or in part.

3. We deliver Packs only within Poland, through InPost sp. z o.o.: to the chosen InPost Paczkomat parcel locker or by InPost courier to the address provided.

4. The Participant is responsible for providing correct and complete delivery details, including a phone number. The parcel must be collected within the time specified by InPost. We notify the Participant of the dispatch and delivery of the parcel by email and, if the Participant has allowed it, also by a notification in the App.

5. If a parcel is returned to us for reasons attributable to the Participant (e.g. an incorrect address or the parcel not being collected), we will resend it at the Participant's request once they have covered the cost of resending it according to InPost's current price list.

6. Photos of Packs and their items in the Service are illustrative – the actual appearance (e.g. the shade of a colour) may differ slightly. The Participant chooses the size and other Pack variants themselves; an incorrectly chosen size does not constitute a lack of conformity of the Pack with the contract.

7. If, for reasons beyond our control (e.g. a product being withdrawn by the supplier), an item of the Pack becomes unavailable, we may deliver an item with no worse features, value and purpose, and we inform the Participant of this before shipping. A Participant who does not agree may, within 14 days of receiving this information, request a refund of the part of the Fee corresponding to the value of the unavailable item – we then ship the Pack without that item.

8. We recommend checking the condition of the parcel on collection and, if it is damaged, reporting this to InPost. This is not a condition for filing a complaint.

§ 13. No right of withdrawal

1. Under Article 38(1)(12) of the Polish Consumer Rights Act of 30 May 2014, a Consumer – and an Entrepreneur with consumer rights – has no right to withdraw from a Registration. A Registration is a contract for the provision of services related to a sports event in which the period of service provision is specified – the dates of the Event or the length of the Counting Window counted from the day the Registration is confirmed. The Pack is an ancillary benefit of that service, shipped as a reward for Completion, and not the subject of a separate sales contract.

2. A Registration is final: once it is confirmed, the Participant may not withdraw from it or request a refund of the Fee, in particular because of a change of plans, illness, injury, lack of time or failure to complete the Event.

3. Sections 1 and 2 do not limit the rights available if the Operator cancels an Event (§ 6(7)) or the Registration does not take effect (§ 7(5)), or the rights relating to a lack of conformity of the performance with the contract (§ 17).

§ 14. Charity Events

1. An Event marked in the Service as a charity Event is an Event from which the Operator donates part of the profit to a charitable cause. The beneficiary, the way the donated amount is determined and the date of the donation are set out on the Event Page.

2. The donation is made by the Operator in its own name. The Fee for a charity Event is remuneration for participating in the Event – it is not a donation by the Participant or a contribution to a public collection, and it does not entitle the Participant to any tax relief.

3. Once a charity Event has been settled, we report the donated amount in the Service or at a Participant's request.

4. Vouchers and Discount Codes do not apply to charity Events.

§ 15. Vouchers, Discount Codes and the Referral Programme

1. We grant Vouchers on the terms and in the amounts stated in the Service at the time they are granted, in particular: as a welcome after the Account is activated, in the Referral Programme, for subscribing to the newsletter, in a loyalty programme or individually (e.g. when handling a complaint). We may change or end individual promotions at any time; this does not affect Vouchers already granted.

2. A Voucher is personal and single-use, has an expiry date shown in the App and reduces the Registration price by the stated percentage – it does not reduce the courier delivery surcharge. When you register, the Service automatically applies the most favourable available Voucher or – where the rules of the Vouchers concerned allow – a permitted combination of them; the total Voucher discount may not exceed the limit stated in the Service.

3. A Discount Code is entered in the Registration form. A code may reduce the Registration price by a percentage or by a fixed amount and has specific conditions: a validity period (a code valid until a given day works until 23:59 on that day), a limit on uses in total and per Account, the Events it applies to and whether it can be combined with Vouchers. If a Discount Code cannot be combined with a Voucher, the User chooses one of those discounts.

4. Vouchers and Discount Codes:

  1. do not apply to charity Events;
  2. cannot be exchanged for cash or any other benefit, and any unused part of a discount is forfeited;
  3. expire after their validity period without any right to compensation;
  4. if used in an order that was cancelled or for which the payment was refunded, are returned to the User if they are still valid.

5. A Voucher cannot be transferred to another Account.

6. Every User receives a referral code which they may share with others (the Referral Programme). A referral is effective if the new User enters the code when registering or uses a referral link, and their Account meets the conditions stated in the Service – in particular, it does not belong to the referrer, has not been referred before and has not previously been used for a paid Registration. The rewards for the referrer and the referred User and the moment they are granted are set out in the Service.

7. In the event of abuse – in particular creating multiple Accounts, referring oneself, using fictitious data or distributing codes in breach of their conditions – we may refuse to grant or apply a discount, cancel Vouchers and Discount Codes obtained through abuse and, in the event of a serious breach, apply the measures described in § 19.

§ 16. Patron Programme

1. The Patron Programme allows Patrons to recommend Events and earn a commission for doing so. Participation in the Programme is voluntary and requires submitting an application through the form on the Service's website and its acceptance by the Operator. We may refuse an application without giving reasons.

2. Once accepted, the Patron receives access to the patron panel (patron.wybiegaj.com), a Patron code and a link to share. The Patron code gives the buyer no discount. A buyer who has entered a Patron code sees the Patron's display name.

3. The Patron is entitled to a commission on paid Registrations for which their code was entered, at the rate shown in the patron panel, calculated on the amount actually paid for the Registration – after discounts and excluding the courier delivery surcharge. No commission is due on free Registrations, on the Patron's own Registrations, on Registrations attributed to an affiliate network or on a single person's Registrations above the limit shown in the patron panel.

4. The Operator may entrust a Patron with the patronage of an Event – the Patron is then entitled to the percentage share shown in the patron panel of the amount of each paid Registration for that Event (excluding courier delivery surcharges). The Patron receives one commission per Registration – at the higher of the rates.

5. A commission becomes available for payout after the waiting period shown in the patron panel (currently 14 days). If the order is cancelled or its payment refunded, no commission is due, and a commission already paid out is settled as a correction reducing the Patron's balance.

6. Payouts are made at the Patron's request submitted in the patron panel, once the available balance reaches the minimum amount shown in the patron panel (currently PLN 100), by bank transfer to an account at a Polish bank indicated by the Patron, within 30 days of the request. The Patron is responsible for the accuracy of the payout details. A payout may require concluding a separate agreement or providing a bill or an invoice.

7. The Patron settles taxes and other public charges on the commissions received themselves, subject to any obligations imposed on the Operator by law as a tax remitter – in which case we pay out the amount reduced by the charges we are obliged to withhold and provide the Patron with the required tax information.

8. The Patron acts in their own name and on their own account; they are not an employee or agent of the Operator and may not make statements on its behalf. In particular, the Patron undertakes:

  1. to recommend the Service lawfully, fairly and without misleading anyone – including about prices, Event rules and the shipping of Packs;
  2. to label advertising content in accordance with the law and the recommendations of the President of the Polish Office of Competition and Consumer Protection (UOKiK) (e.g. “#ad”, “#collaboration”);
  3. not to send unsolicited commercial communications;
  4. not to use the wybiegaj.com name or marks in domain names, profile names or search engine advertising without our consent;
  5. not to generate fictitious Registrations or encourage Registrations by promising to pass on part of the commission, unless we agree to this with the Patron in writing or electronically.

9. In the event of a breach of section 8, we may suspend the accrual and payout of commissions, cancel commissions obtained through the breach and exclude the Patron from the Programme with immediate effect. In other cases, we may end our cooperation with a Patron or the entire Programme with 14 days' notice; the commissions due for the period of participation are then paid out in accordance with section 6, even if the balance does not reach the minimum amount.

10. The Patron may leave the Programme at any time by informing us by email. Before deleting their Account, the Patron should request a payout of the available balance; after the Account is deleted, a payout requires contacting us by email and providing the payout details again.

11. In the patron panel the Patron receives only aggregate statistics – we do not provide them with the personal data of buyers.

§ 17. Complaints

1. A complaint may be submitted by email to kontakt.wybiegaj@gmail.com or in writing to the Operator's registered address. To help us handle it, please provide your contact details, the order number (if applicable), a description of the problem and how you would like it resolved, and – for defective items – photos. These are not conditions for handling a complaint.

2. We respond to a complaint within 14 days of receiving it – to the email address from which it was sent or in another way you indicate.

3. We are liable to a Consumer for the conformity of the Pack with the contract on the terms set out in Chapter 5a of the Polish Consumer Rights Act – for any lack of conformity existing at the time the Pack was delivered and becoming apparent within two years of that time. In the event of a lack of conformity, the Consumer may demand repair or replacement and, on the terms set out in that Act, a price reduction or withdrawal from the contract. We collect the item subject to the complaint at our expense – please contact us before sending it back so that we can provide shipping instructions.

4. We are liable to a Consumer for the conformity with the contract of the digital services provided in the Service, including the operation of the Account and the App, on the terms set out in Chapter 5b of the Polish Consumer Rights Act.

5. We handle complaints about the course of an Event, progress, Completion or results by verifying the recorded data; in such a case, a result determined automatically is checked by a person acting on behalf of the Operator.

6. Sections 3 and 4 apply to Entrepreneurs with consumer rights to the extent provided by law. In relation to other Users who are not Consumers, the Operator's liability under the statutory warranty for defects (rękojmia) is excluded.

§ 18. User Content and reporting illegal content

1. The User is responsible for User Content and declares that they hold the rights necessary to publish it in the Service. User Content must not infringe the law, personal rights or the intellectual property rights of others, and must not contain offensive, vulgar or advertising content or other people's personal data published without a legal basis.

2. The User grants the Operator a free, non-exclusive and territorially unlimited licence to use User Content – for as long as it is stored in the Service – to the extent necessary to provide the services, in particular to store it, make technical copies of it and display it in the Service (e.g. the display name in Rankings). The licence does not cover using User Content for advertising purposes.

3. We are not obliged to monitor User Content. We moderate on the basis of notices and our own findings, and decisions to remove or restrict content and Accounts are taken by people acting on behalf of the Operator. The only automated rules we apply are the rules on the plausibility of Activities and results described in § 9 and § 11.

4. The single point of contact for Users and for the authorities of the Member States, the European Commission and the European Board for Digital Services referred to in Articles 11 and 12 of Regulation (EU) 2022/2065 of the European Parliament and of the Council (Digital Services Act) is kontakt.wybiegaj@gmail.com. We communicate in Polish and English.

5. Anyone may notify us of content they consider illegal by writing to kontakt.wybiegaj@gmail.com. The notice should contain: an explanation of why the content is illegal; a precise indication of the content (e.g. the display name and the Event or Ranking in which it appears); the name and email address of the person submitting the notice (this does not apply to notices of offences involving the sexual abuse or exploitation of children); and a statement that the person submitting the notice believes in good faith that the information in it is accurate and complete. We confirm receipt of the notice, handle it promptly, diligently and objectively and inform the person who submitted it of our decision.

6. If we remove or restrict access to User Content, disregard an Activity or result, or restrict the use of an Account, we provide the User with a statement of reasons for that decision. The decision may be appealed within 6 months by writing to kontakt.wybiegaj@gmail.com; we handle appeals within 14 days. This does not exclude the right to seek redress in court.

§ 19. Rules of use and sanctions

1. In particular, it is prohibited:

  1. to record Activities not performed personally, performed with the help of a vehicle or other aid (unless the Event Page allows it), inflated or fabricated, including by manipulating GPS records;
  2. to create multiple Accounts, use someone else's Account or provide false information;
  3. to circumvent the security measures, restrictions or rules of the Service, including the rules of promotions and the Patron Programme;
  4. to disrupt the operation of the Service, including overloading it, using it through automated means (bots, data-scraping scripts) and attempting to gain unauthorised access;
  5. to use the Service for profit (e.g. reselling Registrations or Packs) without our consent;
  6. to post unlawful content and to harass other Users or people acting on behalf of the Operator.

2. In the event of a breach of these Terms – depending on its seriousness and taking all circumstances into account – we may: warn the User, disregard an Activity or result, void a Completion (§ 9(6)), cancel Vouchers and Discount Codes obtained through the breach, temporarily block the Account or terminate the Account agreement.

3. We may terminate the Account agreement for important reasons with 14 days' notice. Important reasons are: persistent or material breaches of these Terms, the discontinuation of the Service or a material part of it, and an obligation arising from the law or from a decision of a competent authority. In the event of a gross breach of these Terms or the law (e.g. fraud, an attack on the Service, posting criminal content), we may terminate the agreement with immediate effect.

4. We inform the User of a block or termination by email, stating the reason, unless the law prohibits this. An appeal is available in accordance with § 18(6).

5. If we terminate the Account agreement for reasons not attributable to the User, we refund the Fees for Registrations for Events that have not yet ended and for which we have not shipped the Pack. If the reason for termination is a gross breach of these Terms related to participation in Events (e.g. fraud involving Activities or promotions), the Fees for such Registrations are non-refundable and we do not ship Packs for Events not completed before the termination.

§ 20. Liability

1. We make every effort to ensure that the Service works without interruption and errors, but technical breaks (e.g. maintenance, updates, failures) may occur. We announce longer planned breaks in advance where possible. If a break prevented a Participant from recording an Activity, they may enter it manually in accordance with § 9(3).

2. We are not responsible for the operation of third-party services that the User uses in connection with the Service (in particular Strava, Google, Apple, Facebook, PayU, InPost, app stores and telecommunications operators), for the consequences of the User providing untrue or incomplete information or for the effects of force majeure – unless mandatory law provides otherwise.

3. In relation to Users who are neither Consumers nor Entrepreneurs with consumer rights, we are liable only for damage caused intentionally or through gross negligence, excluding lost profits, up to the amount of the Fees paid by the User concerned in the 12 months preceding the event that caused the damage.

4. Nothing in these Terms excludes or limits the Operator's liability towards Consumers and Entrepreneurs with consumer rights to the extent that mandatory law does not permit this – in particular liability for personal injury.

§ 21. Intellectual property and App licence

1. The Service – including the software, graphic layout, logos, texts, photos and medal designs – is protected by copyright and industrial property law. They may not be copied, distributed or used for commercial purposes without our consent, except where permitted by law.

2. For the duration of the Account agreement, we grant the User a non-exclusive, non-transferable and free licence to use the App on their devices, solely for personal purposes and in accordance with these Terms.

3. With regard to an app downloaded from the App Store: the agreement concerning the App is concluded between the User and the Operator, not with Apple Inc.; Apple is not responsible for the App or its content, has no obligation to maintain or support it and does not handle claims relating to the App. Apple Inc. and its subsidiaries are third-party beneficiaries of this provision and may enforce it against the User. Using an app downloaded from an app store also requires complying with that store's terms.

§ 22. Messages, notifications and the newsletter

1. We send messages related to the Account and Registrations (e.g. activation codes, Registration confirmations, information about parcels and about changes to these Terms) to the email address assigned to the Account. The User should keep it up to date.

2. The User can switch push notifications about participation in Events and Registrations (e.g. progress, a Counting Window ending soon or parcel status) on and off in the App settings (Settings → Notifications) and in the device settings.

3. We send the newsletter and marketing notifications (e.g. about new Events, discounts and partner offers) only with the User's consent. Consent can be withdrawn at any time in the Account settings (Settings → Your consents) or using the link in the message, without affecting the lawfulness of processing before the withdrawal. Subscribing to the newsletter through the form on the website requires confirmation via a link sent by email.

§ 23. Changes to the Terms

1. We may change these Terms for important reasons, such as: changes in the law or its interpretation, court judgments and decisions of authorities, the introduction of new or changes to existing features of the Service, a change of service providers (e.g. payment or delivery), security, preventing abuse, a change in the Operator's details or the need to remove ambiguities or editorial errors.

2. We announce a change at least 14 days before it takes effect – by email and in the Service – unless the change results from legislation requiring it to be introduced sooner or concerns only editorial matters or the Operator's details. In the event of a material change, we will ask you to accept the Terms again in the App.

3. A User who does not accept the changes may terminate the Account agreement before they take effect by deleting the Account, at no cost.

4. Registrations concluded before the changes take effect are governed by the Terms in the version in force at the time of the Registration, unless the change is more favourable to the Participant or results from mandatory law.

§ 24. Final provisions

1. These Terms are governed by Polish law. The choice of Polish law does not deprive a Consumer of the protection afforded to them by provisions that cannot be derogated from by agreement under the law of the country of their habitual residence.

2. Disputes with Users who are neither Consumers nor Entrepreneurs with consumer rights are resolved by the court having jurisdiction over the Operator's registered office.

3. A Consumer may use out-of-court complaint and redress procedures – in particular, seek assistance from a municipal or district consumer ombudsman or a consumer organisation, or apply for the dispute to be resolved by a permanent consumer arbitration court at the regional inspector of the Trade Inspection. Information on these procedures is available at www.uokik.gov.pl. If a complaint is not upheld, we will inform you whether we agree to resolve the dispute out of court.

4. The Polish version of these Terms is binding; translations into other languages are for convenience only.

5. These Terms apply from the day they are published in the Service. Previous versions of the Terms are available on request.
